ARTICLE 1 – PURPOSE AND SCOPE
These General Terms and Conditions of Sale (hereinafter the "Terms") govern the sale of the products marketed by RaphCorp (trading as Casemira), whose registered office is located at 20 Avenue des Érables, 35310 Mordelles, France, registered under SIRET number 944 050 665 00024. Contact: contact@casemira.com / 02 59 66 01 35.
Any order placed on the www.casemira.com website implies the customer's full and unreserved acceptance of these Terms.
ARTICLE 2 – PRICES
The prices of our products are shown in euros (€) inclusive of all taxes, taking into account the VAT applicable on the day of the order. Delivery is free on orders of €100 or more for any order shipped to mainland France, Monaco, Luxembourg or Belgium. For any order below this amount, a fixed delivery charge of €9.99 applies and is shown before you confirm your order. Sample delivery is free.
A premium delivery option, "Serenity Delivery", is offered in addition (€19.90 for orders from €100 to €199.99, €29.90 from €200); its content is detailed in articles 5 and 6 bis.
The company reserves the right to change its prices at any time, but the product will be invoiced on the basis of the price in force at the time the order was confirmed.
ARTICLE 3 – PRODUCTS AND CONFORMITY
The products sold are rugs and decorative accessories. We take the greatest care in presenting our products (photos, descriptions). However, as these are textile and sometimes handcrafted products, slight variations may exist:
- Dimensions: A tolerance of +/- 5% on the stated dimensions is accepted (inherent to manufacturing).
- Colours: Colours may vary slightly depending on the calibration of your screen. Such variations cannot be regarded as conformity defects.
Visuals and lifestyle images. The photographs, lifestyle visuals and staged settings shown on the site are for illustration purposes and are not contractually binding. In order to present the products in everyday environments and to help the customer picture them at home, some of the so-called "lifestyle" images are photomontages or visuals generated or retouched by artificial intelligence. The settings, accessories and staging that accompany them are fictitious and are not included in the sale, which relates exclusively to the rug described on the product page. Only the essential characteristics stated in the description (dimensions, materials, colours, composition) are contractually binding, subject to the +/- 5% tolerance mentioned above.
Conversational assistant. The site provides an assistant based on artificial intelligence. Its answers are provided for information and guidance purposes; they are not contractually binding and do not replace these General Terms and Conditions of Sale, the information shown on the product pages, or the description on the order form. In the event of any discrepancy, the latter prevail. For any request affecting your order, please contact customer service at contact@casemira.com or on 02 59 66 01 35.
ARTICLE 4 – ORDERING AND PAYMENT
The customer confirms their order by following the checkout process (basket > information > delivery > payment). Confirmation constitutes signature and acceptance of the transactions carried out.
Payment is made by:
- Bank card (Visa, MasterCard, Amex) via our secure provider Shopify Payments / Stripe.
- PayPal or Apple Pay.
- Payment in 3 interest-free instalments via our partner Klarna. By choosing this payment method, the customer accepts Klarna's terms and conditions. To find out more about how Klarna processes data, you can consult their privacy policy.
Retention of title clause: The products remain the property of Casemira until the price has been paid in full.
ARTICLE 5 – DELIVERY
The products are delivered to the address provided when ordering, in mainland France, Monaco, Luxembourg or Belgium.
When ordering, the customer chooses one of the following shipping methods:
Standard Delivery: €9.99 (orders under €100).
Free Delivery: free (orders of €100 or more).
Serenity Delivery: a premium option on top of free delivery: €19.90 for orders from €100 to €199.99, €29.90 from €200.
The latter includes priority preparation (order dispatched within 24 working hours), priority after-sales service and a commercial "Money-Back Guarantee" extended to 60 days (see article 6 bis).
Sample delivery is free.
Dispatch time: 24 to 48 working hours.
Delivery time: 3 to 5 working days via our partner carriers (DPD or GLS). This transit time is the same for all shipping methods; Serenity Delivery provides priority preparation and after-sales service without changing the transport time.
Transfer of risk: The risk of loss of or damage to the products passes to the customer at the moment they take physical possession of the goods.
ARTICLE 6 – RIGHT OF WITHDRAWAL (RETURNS)
In accordance with Article L.221-18 of the French Consumer Code, the customer has 14 days from receipt of the product to exercise their right of withdrawal.
At Casemira, this "Money-Back Guarantee" period is voluntarily extended to 30 days, and to 60 days for orders placed with Serenity Delivery. This extension constitutes a commercial guarantee, separate from the statutory right of withdrawal, the terms of which are set out in article 6 bis.
Return shipping costs are covered in full by Casemira. To exercise this right, the customer must contact customer service at contact@casemira.com. A prepaid return label or a home collection will be arranged at Casemira's expense. The product must be returned new, intact and complete. In accordance with Article L.221-24 of the French Consumer Code, when the right of withdrawal is exercised within the statutory 14-day period, Casemira refunds all sums paid, including the €9.99 delivery charge that may have been billed on orders under €100. Where the withdrawal relates to only part of the order, this charge is refunded pro rata to the number of items returned. In accordance with the same article, additional costs arising from the customer's choice of a delivery method more expensive than the standard method offered are not refunded.
ARTICLE 6 BIS – "MONEY-BACK GUARANTEE" COMMERCIAL GUARANTEE
Independently of the statutory guarantees (article 7) and the right of withdrawal (article 6), Casemira offers a commercial "Money-Back Guarantee" allowing the return and refund of a product that does not suit the customer.
Duration: 30 days from receipt for all orders; 60 days for orders placed with Serenity Delivery.
Price: included at no extra cost (30 days); included in the Serenity Delivery option: €19.90 for orders from €100 to €199.99, €29.90 from €200 (60 days).
Territorial scope: mainland France, Monaco, Luxembourg and Belgium.
Conditions: the product must be new, unused, complete and properly protected for transport. How to claim: send a request to contact@casemira.com quoting the order number; return shipping costs are covered by Casemira (prepaid label or home collection);
Scope of the refund: the commercial guarantee covers the price of the returned products and the full coverage of return shipping costs. It does not cover the initial delivery charges (the €9.99 charge applied to orders under €100), which remain payable to Casemira where the return request is made from the 15th day after receipt, that is, beyond the statutory withdrawal period. The statutory guarantees (articles 6 and 7) remain entirely free of charge, delivery costs included.
The refund is issued within a maximum of 14 days of receipt of the returned product.
Guarantor: the company RaphCorp identified in Article 1 of these Terms. This commercial guarantee is without prejudice to the statutory guarantees referred to in article 7 (statutory guarantee of conformity, guarantee against hidden defects) and to the 14-day right of withdrawal, which remain free of charge and fully applicable.
ARTICLE 7 – STATUTORY GUARANTEES
All our products benefit from the following statutory guarantees:
- Statutory guarantee of conformity (Art. L.217-4 et seq. of the French Consumer Code): If the product is unfit for its expected use, you have 2 years to act.
- Guarantee against hidden defects (Art. 1641 et seq. of the French Civil Code): If the product contains a hidden defect making it unfit for use, you may request the cancellation of the sale or a reduction of the price.
ARTICLE 8 – LIABILITY
Casemira cannot be held liable in the event of misuse of the product, negligence or lack of care on the part of the customer (e.g. use of unsuitable cleaning products on a wool rug).
ARTICLE 9 – PERSONAL DATA
The information collected is necessary for managing the order. In accordance with the GDPR, the customer has a right of access, rectification and deletion of their data by contacting contact@casemira.com.
ARTICLE 10 – GOVERNING LAW AND DISPUTES
Governing law: These Terms are governed by French law.
Complaints: In the event of a dispute, the customer should first contact Casemira's customer service at contact@casemira.com in order to seek an amicable solution.
Consumer mediation: In accordance with the provisions of the French Consumer Code concerning "the consumer dispute mediation process", after contacting us and in the absence of a satisfactory response within one month, you may make free use of a consumer mediation procedure with:

Jurisdiction: In the absence of an amicable resolution or successful mediation, the French courts shall have sole jurisdiction.
ARTICLE 11 – AMENDMENT OF THE TERMS
The company reserves the right to amend these Terms at any time. The applicable Terms are those in force on the date of the order.
